Zoning, annexation the next step in land deal

The Tri-City Planning Office expects to receive an application by May 2 for a zoning change and annexation request involving the pending transfer of 25 acres of Flathead Valley Community College land to Philip Harris, owner of Signature Theatres.

Planning officer Narda Wilson said the office needs a formal application by that date to place the request on the agenda for the June 14 planning board meeting.

According to the college's agreement with Harris, the land deal becomes final only if the city of Kalispell approves the annexation and change to business zoning.

In exchange for the 25 acres, the college receives 109 acres of riverfront property and a $300,000 payment.

Wilson said she believes that Harris plans retail/commercial development for the property that is now zoned suburban agricultural.

Last summer, Harris and Signature announced plans to build a 14-screen movie theater complex as part of a 21-acre development on U.S. 93 just south of the Target/Home Depot center.

The new development, Hutton Ranch Plaza, also was to include 150,000 square feet of mixed commercial and retail use, including two major retailers as well as restaurants and smaller shops.

The 25 acres acquired from the college will expand the land Harris has available for development.

Wilson said the office probably will pursue a planned unit development.

"It's something we recommend that they use," Wilson said. "It's very detailed compared to just zoning."

She said that requires the developer to map out a specific site plan with types of uses allowed, access, parking, foundation locations and building design.

Wilson said planned unit developments are particularly important since the planning board hasn't yet adopted architectural design standards. The board recently held a public hearing on proposed standards.

Wilson said she didn't anticipate any problem with the zoning and annexation request. Most of the adjoining property has already been annexed into Kalispell.

If the developer meets the May 2 deadline, the change request would go before the Kalispell City Council at its July 5 meeting.

College trustees approved the trade at their board meeting Monday. There is a 14-day public comment period on the land deal.
