Chaz Carraway, 18, admits violating conditions of release

A teenager awaiting trial on a rape charge from September was jailed Monday for violating conditions that had allowed him freedom while awaiting trail.

Chaz Carraway's trial begins Friday. He's accused of raping a 17-year-old girl at a party at his house. The girl said she was extremely intoxicated, so her friends did not want to take her to their home. According to court information, the girl's friends walked her to Carraway's bedroom and put her in bed. She said she awoke to find him having intercourse with her.

After her complaint to law enforcement, a rape exam was conducted on her. Carraway admitted having sex with her and said that she was "drunk," documents show.

Carraway was charged with sexual intercourse without consent. He was released on his recognizance to his mother's supervision with a number of conditions.

On Monday, Carraway appeared in court and admitted he violated conditions.

Carraway, 18, was to have no unsupervised conduct with girls younger than 18. His attorney, Jack Quatman, said that Carraway admits having sex recently with a 17-year-old friend of the alleged victim. He also admits violating house arrest by skiing Sunday at Big Mountain, not living with his mother who was to supervise him, and having contact with witnesses in the case. Carraway said he allowed a friend, who is a witness, to live with him.

Quatman characterized the ski trip as "stupid, but he's 18 and the snow was good and he had no place to go."

The teenage girl went willingly to Carraway's house, Quatman said, and then came back the next night.

"Other than a couple of incidents, he's been pretty good," Quatman said about Carraway.

Deputy County Attorney Dan Guzynski disagreed.

"It seems to me, the defendant has had contact with nearly every witness in this case."

Quatman said Carraway and the witnesses are friends.

"That's what this case is all about - a bunch of kids drinking and having sex."

Quatman said Carraway goes to LASER School and is employed. But Flathead County sheriff's Deputy Jordan White said the school principal told him that Carraway no longer attends school there.

District Judge Stewart Stadler refused Quatman's request to release Carraway from jail on his recognizance.

He has to "maintain the court's credibility," he said, and that is not possible if a defendant violates conditions of release.

"You chose to just absolutely disregard the conditions," Stadler said. "You're doing just exactly what you wish to do."

He set bond at $100,000, which Carraway said he will be unable to post.

If convicted of rape, Carraway faces from two to 100 years in prison.
