Hayden man faces multiple charges

SANDPOINT — A 29-year-old Hayden man was arrested early Christmas morning on a raft of criminal charges following a felony drunken driving investigation.

Andrew Nicholas Magnus was ordered held Monday in lieu of $25,000 bail, according to court records. He is charged with driving under the influence, possession of a concealed weapon while under the influence, leaving the scene of a property-damage crash, failing to notify authorities of the crash and possession of an open container of alcohol.

An Idaho State Police trooper stopped Magnus for erratic driving on U.S. Highway 95 in Colburn at about 5:30 a.m. Magnus smelled of alcohol and failed field sobriety tests, the arrest report said.

A loaded and cocked Colt 45 was found beneath a pile of clothes in the cab of his pickup truck.

A .480-caliber Ruger pistol and an AK-47 assault rifle, both of which were loaded, were also located in the cab, the report said.

Fresh body damage on the front corner of the pickup truck was discovered. Magnus told the trooper he struck a tree in his driveway, although the trooper noted that he could find no evidence on the vehicle to substantiate that claim, the report said.

The DUI charge against Magnus rose to the felony level because of two prior convictions for the same offense in Kootenai County within a 10-year period, court records indicate.
