No charges filed against Walters, Pearson

Troy’s former chief of police Mitch Walters and officer Kit Pearson, whose resignation goes into effect Monday, will not be charged for alleged criminal wrongdoing related to a Nov. 19 conversation that they unintentionally broadcast over a police radio.
“Following my review, it is my opinion that while the conversation was unprofessional, there is insufficient evidence to support probable cause for filing any charges on this matter,” county attorney Bernard Cassidy wrote in a letter Tuesday addressed to sheriff Daryl Anderson, who requested the investigation.
The state Justice Department’s Division of Criminal Investigation completed the investigation Dec. 18. Cassidy reviewed the report and listened to a recording of the 3-minute, 47-second conversation in question.
The broadcast, Cassidy wrote, “involved discussion of City of Troy property and also comments deemed to be derogatory and vulgar.”
“Basically, all (the report) said was that there were allegations of official misconduct and attempted theft,” Anderson said.
