River cleanup suit to be filed

POST FALLS - The Post Falls City Council on Tuesday night passed a resolution affirming that the city will file a lawsuit against Washington Ecology and the Environmental Protection Agency over the Spokane River cleanup plan.

Another wastewater discharger, the Hayden Area Regional Sewer Board, will consider joining the lawsuit next week. It is unclear whether Coeur d'Alene, which also has concerns over the plan, will join the effort.

Post Falls City Administrator Eric Keck said dischargers want to do their part to reduce phosphorous from the river, but they believe the plan doesn't treat agencies on both sides of the border the same.

The EPA in May said it supports Ecology's plan despite the Idaho agencies' protest, finally making the document official after 12 contentious years.

The proposed permits were expected to be available for public comment in August and issued in early 2011, but a suit could delay the process.

In other business, the council approved street closures for the River City Rod Run on July 16-17 and the Body by Scotty Block Party on July 30.

The council said Rod Run organizer Rob Elder will be responsible for repairing damage to the street caused by burnouts.
