Lawsuit seeks to stop annexation

COEUR d'ALENE - A group of citizens is suing to prevent the city of Harrison from annexing the Powderhorn Ranch Inc. subdivision.

The litigation, filed by attorneys Scott Reed and Kathlene Kolts on Wednesday, claims the 2,000-acre property shouldn't be incorporated into the city limits since the two property lot lines don't touch, nor has the annexation received the consent of affected landowners.

Powderhorn Ranch is across Lake Coeur d'Alene from Harrison. The suit claims the property lines are only adjacent underwater. Underwater lands belong either to the state of Idaho or Coeur d'Alene Tribe in that area, and not to the city of Harrison.

The city is 3,826 feet east of the nearest Powderhorn Ranch property, all of which is underwater and therefore not "contiguous" to annexation requirements.

The 2,000-acre property plans to develop 1,300 luxury houses with three golf courses in a gated community that will transform the rural community, the suit states.

Representatives from Powderhorn, who have approached the city of Coeur d'Alene to negotiate water right trade discussions, could not be reached for comment.

Harrison City Attorney Nancy Wolff could not be reached for comment.

The property was annexed by the Harrison City Council, and its ordinance notice published in the St. Maries Gazette Record on Oct. 13.
