SMELTERVILLE - A Post Falls man was arrested Sunday in Smelterville after an altercation that allegedly involved a brick.

Marcus Hobart Sample, 30, originally taken into custody for aggravated assault, was charged with disturbing the peace and resisting and obstructing law enforcement.

The Shoshone County Sheriff's Office and Kellogg Police Department were dispatched about 8 p.m. to the 300 block of Main Street, where they found a brick laying in the parking lot.

A man who flagged down police said he had witnessed the altercation and said Sample was inside his house.

According to a KPD report, the witness told officers "Mark threatened to hit (the victim) with a brick."

Police said Sample emerged from the house without a shirt allegedly intoxicated and "screaming that he did not do anything and just wanted to go back inside and go to bed."

Sample ran back in the house. Police followed and arrested Sample, who resisted by throwing "headbutts" and kicking at officers, the police report said.

Sample was transported to the Shoshone County Jail, where he posted bond and was released Monday.
