Man gets 3 years in strangulation

COEUR d'ALENE - A 41-year-old Coeur d'Alene man has been sentenced to nearly three years in state prison for attempted strangulation and felony domestic violence.
First District Judge Fred Gibler sentenced David B. Moen on Monday, declining to grant him credit for the 257 days he has already served in jail waiting for his sentencing. Moen will not be eligible for parole before his 33-month term is completed.
Moen admitted to the charges related to a September 2010 incident involving his then girlfriend, according to Kootenai County prosecutors.
Moen choked his girlfriend in the incident, banged her head against a wall, punched her in the head repeatedly, and kicked her in the head several times, prosecutors said.
Kootenai County Deputy Prosecutor Terri Laird handled the case.
Prosecutor Barry McHugh, speaking for his office, said, "Mr. Moen received a fair sentence. His conduct reveals his inability, at this time, after many convictions, to comply with society's rules."
Moen has an extensive criminal record, which includes five prior felony convictions and 17 misdemeanor convictions. He was on federal probation at the time the crimes in this case were committed, McHugh said.
"Incarceration is appropriate to protect our community from his violent nature," McHugh said. "Following his incarceration, we hope his federal probation will continue so that sufficient incentives are in place to convince Mr. Moen to avoid further violations."
