SANDPOINT — Mediation is being proposed to resolve the criminal case against a former grocery store manager accused of using his position to embezzle funds from his former employer.

The proposed mediation order in Jasen W. Johnson’s case was filed Monday in 1st District.

If the court approves the mediation proposal, it could lead to reduced charges or a even a dismissal, according to the proposed order. Talks would also cover sentencing recommendations and restitution.

By mutual agreement of Bonner County Deputy Prosecutor Shane Greenbank and Johnson’s defense counsel, Michael Palmer, former Senior District Judge James Michaud would serve as mediator in the case.

Johnson, 49, was charged with grand theft for allegedly exploiting his knowledge of Oldtown Family Foods’ accounting procedures to steal from the company from 2002 to 2009. As much as $439,000 was allegedly misappropriated over the years, according to court documents.

Johnson pleaded not guilty.

If mediation is not allowed or proves fruitless, a seven-day jury trial is set for June. Proceedings have been repeatedly delayed because the complexity of the case and an immense amount of financial and employment records.

The operators of Family Foods are suing Johnson in civil court for embezzlement and interfering with the growth of their business. The suit alleges Johnson stole more than $450,000.

A five-day jury trial in that matter is also scheduled for June.

Mediation was used last year to resolve a Priest Lake murder case.
