Post Falls couple sues Kroc Center

COEUR d'ALENE - A husband and wife, both members of the Kroc Center, have filed a lawsuit against the owner of the popular recreation facility after the wife said she was tripped there and injured.
Sheri and Gene Stone, of Post Falls, filed the lawsuit earlier this week in 1st District Court in Kootenai County through attorney Samuel Eismann, of Coeur d'Alene.
The lawsuit lists The Salvation Army, the Kroc Center, and an unnamed male employee as defendants.
"I feel really bad that anyone fell at the Kroc and received injuries," said Maj. John Chamness, executive director of The Salvation Army Kroc Center.
He said he hadn't heard of the lawsuit.
According to the suit, Sheri Stone was at the Kroc on the morning of July 29, 2010, and "participating in activities allowed to members."
It said she was "negligently tripped" by an employee who was playing pool at the time and "not paying attention to his surroundings or those around him."
Sheri Stone fell to the ground and suffered "grievous and permanent injuries to her person," the suit said.
The court documents noted past and future medical bills that are a result of her injuries.
The suit said she also suffered emotional distress, loss of enjoyment of life, disability, pain and suffering, inability to engage in normal activities and probable loss of income.
Gene Stone suffered "loss of consortium due to the injuries sustained by his wife and her resulting disability..."
A legal dictionary defines "loss of consortium" as the inability of a person's spouse to engage in marital relations.
The Stones both are seeking damages that exceed $10,000 and will be proven at trial, the suit documents said. They also are seeking attorney fees.
