Cd'A man sentenced for growing marijuana
Coeur d'Alene Press | UPDATED 12 years, 5 months AGO
COEUR d'ALENE - A 50-year-old Coeur d'Alene man will spend one to two years in prison for operating a marijuana grow operation at his residence.
John P. Musante was sentenced Thursday by 1st District Judge Lansing Haynes, who ordered that the first year of a two year sentence be fixed. He was charged with possession of marijuana with the intent to deliver, according to the Kootenai County prosecutor's office.
Musante admitted to the grow operation, and was found with 34 growing plants and a number of dried plants. He was arrested on Jan. 18, 2012.
At the time, Musante was in possession of a sawed-off shotgun and a .22-caliber handgun, despite being prohibited from gun possession because of a prior felony conviction.
His criminal history dates back to 1982 and includes convictions for theft, burglary, two convictions for receiving stolen property, and probation violations.
Kootenai County Prosecutor Barry McHugh said, "Mr. Musante was selling marijuana and taking weapons for payment, both of which were felony offenses. His disregard for the law after numerous convictions demonstrates that he is an unfit candidate for probation at this time."
