POLSON — A local pie seller, who according to court documents tried to offer his product while under the influence, was sentenced to five years in jail for his fourth DUI in District Court last Wednesday.

On May 31, authorities received a call from a witness that said an intoxicated male had driven up their driveway and was drinking a beer in his truck, which had a sign on it that said “Roger’s Pies.” The male, who turned out to be 59-year-old Roger Bordeaux, tried to sell him a pie.

Police then contacted a neighbor of the witness who, according to court documents, said that Bordeaux was parked on Ninepipes Road and was allegedly urinating on the side of the road. The neighbor then said that Bordeaux headed toward Charlo.

Tribal police located Bordeaux’s truck at Tiny’s Bar in Charlo and found him outside. The officer said that he had the smell of alcohol on his breath, his speech was slow and slurred and his eyes were red and glossy. The affidavit said he hadn’t entered the bar.

The officer said there was also an open Budweiser can in Bordeaux’s truck and an empty can in the back. Bordeaux also appeared to sway back and forth when talking with authorities and failed the one leg stand test and the walk and turn test.

Bordeaux provided a breath sample that registered .178.

Bordeaux had three prior convictions for DUIs, and pleaded not guilty to the fourth charge on June 8, 2011. He would eventually sign a plea agreement on Nov. 16 and was given a sentence last Thursday of 20 years in the Department of Corrections with 15 suspended.
