Woman jailed for alleged negligent homicide

A 33-year-old Kalispell woman is in jail after being arrested Wednesday on a warrant for negligent homicide.
According to a court document, Mindy Brist, 33, of Kalispell, was the driver of a 2005 GMC Envoy when it crashed on U.S. 93 just south of Somers in the early morning hours of Feb. 18. Brist’s passenger, Timothy Attard, was killed in the crash.
After the accident, a trooper with the Montana Highway Patrol said the vehicle was northbound heading into a right-hand curve when it drifted across the center turn lane and into the opposing lane and back.
An overcorrection brought the vehicle back across the center turn lane and across the road, going airborne over the shoulder.
The vehicle landed, struck an embankment, spun, flipped and came to rest on its passenger side.
The court document states that Brist told police she and Attard had been out drinking and gambling, and that she had also taken a Lortab pill sometime in the six hours preceding the crash. A blood sample obtained from Brist measured at 0.06 percent, below the legal limit.
An investigation of the crash scene by the trooper allegedly indicated the vehicle had been traveling more than 90 miles per hour in an area with a speed limit of 45 miles per hour when it entered the turn.
If convicted of the felony, Brist faces up to 20 years in jail and a fine of up to $50,000.
Brist is being held in the Flathead County Detention Center, where her bond is set at $10,000. Her next court date is Aug. 2.
