Sex abuse case moves to 1st District Court

COEUR d'ALENE - A North Idaho firefighter charged with multiple felony counts for having sex with a minor waived his preliminary hearing late last week and now his case has been moved up to 1st District Court.

Billy E. Miller Jr., 38, of Athol, now is facing charges of sexual "crime against nature," two counts of lewd conduct with a child under 16, and sexual abuse of a child under 16, according to court documents.

Miller had been working as a lieutenant for Northern Lakes Fire District before being arrested early last month.

The preliminary hearing was set to determine whether there is enough evidence to warrant a trial in District Court.

The case has now been assigned to Judge John Luster. A date has not been set for his arraignment in District Court, when he will enter a plea.

He's currently being held in Kootenai County jail on $150,000 bond.

The alleged crimes occurred at his home on the 26000 block of North Harrier Lane.

Miller, according to a Kootenai County Sheriff's Department investigation report, allegedly admitted to having sex with the girl in 2009 and 2010. He used a condom to prevent pregnancy, the report said. He also allegedly admitted to receiving oral sex from the girl, who was in junior high school at the time.

After his arrest, Miller was placed on paid administrative leave by Northern Lakes officials. Fire Chief Dean Marcus wasn't immediately available for comment Monday on Miller's current status.

Miller could be facing up to life in prison if convicted of one of the lewd conduct with a child charges.

His defense attorney, Brad Chapman, couldn't immediately be reached for comment Monday.
