Shooting suspect's bond set at $500K

COEUR d'ALENE - A District Court judge set a preliminary bond of $500,000 on Friday for a Coeur d'Alene man who allegedly shot at an ex-girlfriend's duplex and then barricaded himself in his apartment with several weapons.

Zebulon Batke, 33, said during his first appearance that the bond was high and he wouldn't be able to bond out.

Batke has been charged with two felony counts of shooting into an occupied residence and one felony count of aggravated assault.

Judge Clark Peterson said he could "count on one hand" the number of bonds he has been asked to set that high.

Ken Brooks, representing the state, said Batke on Thursday had violated a $40,000 bond for a pending felony DUI from earlier this year.

Batke violated the bond by committing a new offense, and also by driving his vehicle and consuming alcohol, both of which he had been restricted from doing.

"We believe he would continue to do so if the bond were lower," Brooks said.

Brooks also described Batke as violent and dangerous.

"If he's capable of doing this, the state can't conceive of anything he's not capable of," Brooks said.

Brooks listed that Batke had been convicted of an invalid license and inattentive driving in Kootenai County in 2006, convicted of a DUI in California in 2006 and convicted of battery in Kootenai County in 2006.

Peterson said that though Batke appeared to be rational and calm during the preliminary hearing, the contents of police reports painted him otherwise.

"What is contained in these papers are startling and create a great deal of risk to the public," Peterson said. "It gives the court concern you could carry out many of the dangerous actions referred in the police records the court has reviewed."

Batke said he has struggled with a drinking problem.

"I've been dealing with this alcohol problem for a long time, and it's been horrible," he said. "Obviously, I just can't seem to do anything about it."

Peterson said a preliminary hearing would be set for Batke within 14 days.

A public defender will be appointed for Batke.

Peterson also issued set a no-contact order requested by Jasmine and James Reed, Batke's ex girlfriend and her father.

Batke said he understood all the court proceedings.

Batke was arrested on Thursday after allegedly shooting several shots at Jasmine's duplex on Third Street. He then barricaded himself in his apartment bedroom in Coeur d'Alene. After evacuating neighbors, a multi-agency SWAT team breached his door and detained him.
