Second man sentenced for robbery

EPHRATA - A second man was sentenced to more than two years in prison for helping to steal a dead gang member's dog.

Emilio E. Hinojosa, 17, Moses Lake, pleaded guilty to robbery in the first degree and unlawful possession of a firearm in the second degree in Grant County Superior Court, according to court records.

Hinojosa has previous convictions for theft in the first degree and taking a motor vehicle without permission in the second degree, according to court records. When combined with his present convictions, he faced a sentencing range of two years and 6.75 months to three years and 4.75 months in prison.

Prosecutors recommended the low end of the sentencing range for Hinojosa, according to the guilty plea statement.

Grant County Superior Court Judge John Antosz sentenced Hinojosa to the minimum end of the sentencing range, two years and 6.75 months.

"In this case, the defendant plead guilty to two major charges. This defendant, who was prosecuted as an adult, was 17 years old at the time and had no history of violent crime," prosecutor Angus Lee stated. "His role in this case was as an accomplice and he was at no time armed with a weapon. He will, for his actions, be spending a significant amount of time incarcerated and this conviction will count as a strike under the three strike law."

Hinojosa was one of the four gang members accused of robbing a man for a dog, which belonged to Luis Martinez. Martinez was shot and stabbed to death during a fight at a Soap Lake party in June, according to court records.

Christopher J. McCarrell, 25, pleaded guilty to robbery in the first degree and unlawful possession of a firearm in the first degree in February. He was sentenced to three years and 6.75 months in prison.

Eric Martinez, 17, Moses Lake and Thomas Henderson, 17, Soap Lake, remain charged with robbery in the first degree, according to court records.

Henderson faces an additional charge of unlawful possession of a firearm in the first degree, according to court records. Eric Martinez faces an additional charge of unlawful possession of a firearm in the second degree.

Eric Martinez reportedly went to a Denton Road trailer outside of Moses Lake to collect, Luis Martinez's dog, according to a Grant County sheriff's report. After Luis Martinez' death, his dog was taken to an animal shelter, where the alleged victim adopted it four months prior to the crime, according to the police report.

After a woman picked up Eric Martinez, they reportedly picked up McCarrell, Henderson and Hinojosa, according to the police report. Eric Martinez reportedly told them they were going to get the dog whether the victim liked it or not.

The group pulled into the victim's driveway as he was smoking a cigarette, according to the police report. The four gang members, wearing bandanas around their necks, reportedly got out of the vehicle, and Eric Martinez told the man he came to get the dog.

The victim reportedly told Eric Martinez he purchased the dog, and he wanted money if they were going to take it, according to the police report. As they were talking, McCarrell unchained the dog and put it in the SUV. He entered the residence and the victim's girlfriend yelled at him to get out.

The victim told police they were talking when sheriff's deputies arrived on the scene, according to the police report. Officers saw McCarrell exiting the residence.

Police allegedly found two shotguns in the SUV and a .40 caliber pistol on McCarrell, according to the police report.

Eric Martinez reportedly told police he went to speak to the victim alone and agreed to pay for the dog before police arrived. When police questioned why they allegedly had guns and were wearing bandanas, Eric Martinez couldn't explain it.

Thomas Henderson has a previous conviction for eluding a law enforcement water craft vessel, according to the police report.

Two other alleged incidents are connected to Luis Martinez' death, including a robbery and an attack on people at a motel room, according to court records.
