POLSON — The case between Linda Jonas and Edwin Jonas III appeared to come to a close on Wednesday September 26, as the participants gathered in Judge McNeil’s court for a hearing on legal fees. According to court documents, Linda Jonas requested the court to order Edwin Jonas III and his counsel to pay the costs, expenses and attorney fees incurred. The parties informed the court that they had reached a resolution in this matter.

 After almost 10 years of disputing non-payment, the outcome was the sale of the cattle and property of Blacktail Mountain Ranch Co., LLC. According to court documents, on September 18 the plaintiff (Linda Jonas) took possession of the cattle and sold them at auction market. In addition, she took possession of the property occupied by the defendant and ejected him from the residence.

 According to court documents, on Feb. 3, 2010 the charging order authorized the court-appointed receiver to sell the property and assets of the Blacktail Mountain Ranch Co. in order to provide compensation of non-payment to Linda Jonas, with the remainder going to Edwin Jonas III.

Edwin Jonas III and his counsel appealed the order three times, and all three times the motion was denied, according to court records. Connie Jonas, the current wife of Edwin Jonas III, brought a number of motions to stop the selling of assets of the company. These included: a motion to intervene, motion to vacate charging order, motion to quash writ of execution and writ of assistance as well as a motion for temporary restraining order, according to court documents.

Each of these were withdrawn upon good cause showing at the Sept. 26 hearing.
