Cases dropped against pair charged with sex crimes

A pair of cases filed against a woman alleged to have been prostituting a 13 year old girl to a man for drugs as well as the man himself are no longer being pursued.
Friday, a case against 34-year-old Daniel Parmer Smith was dismissed after the Flathead County Attorney’s Office entered into a deferred prosecution agreement with Smith.
So long as Smith now follows the requirements of the agreement, which are private between the attorney’s office and Smith, the felony charges of sexual intercourse without consent, accountability to sexual intercourse without consent and sexual assault initially filed against him will no longer be pursued.
Smith was alleged to have raped and molested a 13 year-old-girl, an activity facilitated by Jennifer Ellen Johnson, 45, in exchange for him providing the woman with drugs. He was also alleged to have let a 19-year-old friend have sex with the girl as well.
If Smith’s case had proceeded to a jury trial, which was scheduled for Monday, April 8, he would have faced between four years and two consecutive life terms plus 100 years in prison and a fine of up to $150,000 if convicted of all his charges.
Johnson was charged with felony aggravated promotion of prostitution, a conviction of which could have brought a sentence of between four and 100 years and a fine of up to $100,000. She, too, entered into a deferred prosecution agreement, and her case was dismissed July 6, 2012.
Like Smith, if Johnson follows the requirements of her agreement, her case will remain closed.
