Man challenges bail-jumping charge

A 37-year-old Kalispell man pleaded not guilty Jan. 31 in Flathead District Court to a felony charge of bail jumping.
The charge was filed against Joshua Mattingly after he failed to appear for his Oct. 9, 2012, sentencing for a 2010 case in which he pleaded guilty by way of Alford to felony criminal possession of dangerous drugs.
A felony charge of robbery was dropped as part of a plea agreement that recommended a five-year prison sentence.
A court document initially alleged that on March 23, 2010, Mattingly walked up to a woman who was outside with her son and demanded she give him her pills. She told him no and he allegedly reached in her coat pocket to take them, grabbing her arm and turning her around so he could get to them.
The document said they struggled over the pills and the bottle opened, dropping pills on the ground. Mattingly then allegedly grabbed pills off the ground and left. He allegedly escaped with several OxyContin pills.
Mattingly also is charged with felony counts of kidnapping and criminal endangerment in another case.
According to court documents, Joshua Mattingly would not allow his ex-girlfriend and her children to leave a house on Feb. 2, 2012. When she took her children outside and tried to get in her car, he allegedly began punching and kicking her, knocking her to the ground and dragging her back in the house.
Mattingly allegedly continued to punch and kick her in the head, hip and back while she tried to get her head under a bed to protect herself.
A neighbor told deputies with the Flathead County Sheriff’s Office that she heard a woman outside screaming and yelling “no, no.” She said she saw Mattingly drag her back in the home.
The witness also said she saw one of the woman’s children run to the road and yell “daddy is kicking mommy in the face and beating her up.”
He pleaded not guilty to charges in that case on Feb. 23, 2012.
If convicted in the new cases, Mattingly faces up to 10 years in prison for the bail jumping charge and between two and 20 years and a fine of between $100 and $100,500 in the kidnapping and criminal endangerment case.
His next hearing in the kidnapping case is March 6, his next hearing in the bail jumping case is Feb. 13 and his next hearing in the drug possession case is April 4.
