Three defendants deny fourth DUI charges

Three defendants pleaded not guilty Thursday in Flathead District Court to what would be their fourth offenses for drunk driving.
Karen Downs, 61, Columbia Falls, was arrested during a Jan. 18 traffic stop on U.S. 2 after allegedly failing field sobriety tests and refusing to provide a breath sample. She allegedly said she had really “(expletive) up this time.”
Her prior convictions for drunk driving came in June 1999, January 2003, and April 2003. Her next hearing is scheduled for April 10.
Bradley Franklin, 40, Kalispell, was arrested during a Feb. 2 traffic stop on the U.S. 93 bypass after police received a report of a Roto Rooter truck driving erratically. Franklin allegedly denied he had been drinking before failing field sobriety tests and refusing to provide a breath sample.
His prior convictions for drunk driving came in January 1995, March 2005, and September 2012. His next hearing is scheduled for June 12.
Michael Carter, 62, Kalispell, was arrested after allegedly driving his pickup truck off Foothill Road. Carter allegedly admitted he had been drinking and was unable to perform field sobriety tests, later refusing to provide a breath sample.
His prior convictions for drunk driving came in June 1991, December 1993, and May 1994. His next hearing is scheduled for May 8.
Carter was incarcerated at the time of his hearing because he could not afford the fees associated with an alcohol-monitoring bracelet, but was released on his own recognizance by District Judge Robert Allison under the requirement that he participate in the 24/7 Sobriety Program, a less expensive alternative.
If convicted, Downs, Franklin and Carter each face up to five years in prison and fines of between $1,000 and $10,000.
