Somers man ordered to pay for portable toilets

A 22-year-old Somers man was given a six-month deferred sentence Jan. 3 in Flathead District Court to a reduced charge of criminal mischief after setting two portable toilets on fire three and a half years ago.
Kyle Kavert originally was charged with arson after two portable toilets were destroyed by fire on June 4, 2009.
In court, Kavert — through questions asked by his attorney — admitted he was smoking “a substance” in one of the portable toilets when he accidentally dropped it into an alcohol rub that “most likely” resulted in the portable toilet burning down, with an adjacent toilet also catching fire and burning.
A court document alleged Kavert and several others were riding their bicycles through the area when Kavert went into one portable toilet, came out and went into the other. It alleged he then came running out, got on his bicycle and yelled for everyone to leave quickly, later stating he put all the sanitizer in the urinal of one of the portable toilets and lit it on fire.
That story was allegedly corroborated by one of the other people who was present.
In addition to his deferred sentence, Kavert was ordered to pay $600 in restitution, a $100 fine and a $75 surcharge.
