Man denies burglary charge

A 28-year-old Kalispell man pleaded not guilty Thursday in Flathead District Court to a felony charge of burglary.

Dustin Marvin was apprehended by Flathead County deputies on the property of Rocky Mountain Contractors on Dec. 23, after a burglary alarm was triggered.

According to a court document, a deputy saw a flashlight through an open door and could hear metal and other items being moved around when he arrived at the scene. He then saw Marvin walking out of a building wearing a headlamp and a black ski mask.

Upon being seen and arrested, Marvin allegedly said “(expletive), I’m in big trouble now.”

Near Marvin, the deputy found several bound rolls of copper wire, all identified as belonging to Rocky Mountain Contractors. The wire ends reportedly had been cut in an attempt to steal the material.

If convicted, Marvin faces up to 20 years in prison and a fine of up to $50,000. His next hearing is April 10.

In addition to his potential sentence, Marvin could have a deferred sentence revoked in a 2010 case in which he pleaded guilty to a reduced charge of felony theft.

He was given a three-year deferred sentence Oct. 19, 2011, in that case, but admitted violating the requirements of his sentence in November 2012. Rather than receiving a suspended sentence or jail time, Marvin’s sentence was re-deferred for another three years at that point.

A new revocation hearing was set for Jan. 17.
