A Kalispell man was sentenced to five years with the Montana Department of Corrections and five years on probation after pleading guilty to four charges across three cases and three years in Flathead District Court.

Joshua Mattingly, 38, was sentenced Thursday for felony counts of criminal endangerment, bail jumping and criminal possession of dangerous drugs and a misdemeanor count of partner or family member assault.

He had pleaded guilty by way of Alford to the drug charge.

Mattingly also has a 2004 conviction for robbery and aggravated assault, according to a court document.

The 2010 drug charge came after Mattingly was found in possession of Oxycontin. An additional felony charge of robbery in that case was dismissed.

All but the bail jumping charge came from a 2012 case in which Mattingly assaulted his ex-girlfriend in front of her child — shoving her, punching her and kicking her. At one point the child ran outside to the road for help, yelling, “Daddy is kicking mommy in the face and beating her up.”

The bail jumping charge was filed in 2012 after Mattingly failed to appear for an October 2012 sentencing hearing.

District Judge Ted Lympus, who handed down Mattingly’s sentence, made a recommendation that Mattingly be placed in the Connections Corrections Program, a 60- to 90-day residential chemical dependency treatment program for male inmates, to be followed by pre-release, in which he would be transitioned back into the community.
