Rathdrum man receives sentence
Coeur d'Alene Press | UPDATED 11 years, 7 months AGO
A 26-year-old Rathdrum man has been sentenced to serve up to eight years for aggravated battery and other felonies.
Tyler Scott Sain was also charged with attempted grand theft and burglary after an incident on Dec. 9 in Coeur d'Alene.
Sain was sentenced by District Judge Ben Simpson, who ordered that the first three years be fixed and the remaining five indeterminate. All sentences were ordered to run concurrently.
According to a press release from the Kootenai County Prosecutor's Office, Sain tried to drive away in the car of a man who had left it for a few minutes while it was warming up.
When the victim saw Sain trying to drive away, the victim drew his legally concealed firearm and ordered Sain to stop. Instead, Sain hit the victim with the vehicle. Sain then stopped and fled on foot.
The victim caught Sain and detained him until officers arrived.
The eluding an officer, possession of methamphetamine and misdemeanor injury to child charges resulted from a Dec. 6 incident.
An officer woke Sain in a parked vehicle. Sain fled and a high-speed pursuit ensued. Sain drove into the backyard of a residence and fled on foot, leaving his 10-year-old nephew alone in the car. Meth was found in the vehicle along with Sain's identification.
Sain's criminal history includes felony convictions for possession of stolen property, escape and possession of a controlled substance.
"Mr. Sain has had prior opportunities with drug treatment, felony probation and imprisonment to alter his drug use and criminal conduct," Kootenai County Prosecutor Barry McHugh said in the press release. "None of them have worked. The longer term of imprisonment affords Mr. Sain another opportunity to change his life."
