Pair plead not guilty to heroin-related charges

A man and woman pleaded not guilty Thursday in Flathead District Court to charges related to the woman’s alleged drug sales.

Tonya Henderson, 27, Kalispell, is charged with felony counts of criminal distribution of dangerous drugs and criminal possession with intent to distribute, while Bryan Schloss, 29, Whitefish, is charged with felony criminal possession of dangerous drugs.

According to a court document, Henderson is alleged to have sold six “points” of heroin, or 0.6 grams, to a confidential informant on March 6 for $175 before saying she had two more grams she could sell.

She then walked to her room at the Blue and White Motel.

A subsequent search of her car uncovered a zippered case containing syringes, a digital scale, straws, 23 jewel bags, roughly 1.1 grams of believed heroin and the $175 used in the undercover buy.

Schloss was in the motel room with Henderson during the search. He was allegedly found to have a jewel bag containing 2.1 grams of heroin in his pocket.

While Henderson has no notable criminal history, Schloss was given a five-year suspended sentence in March 2011 after being convicted of felony accountability to criminal possession of dangerous drugs, reduced from felony attempted robbery.

That charge stemmed from an incident in which Schloss was shot four times with a .40-caliber handgun while trying to steal cocaine from David Palumbo west of Kalispell in 2009. While the robbery failed, Schloss later ran up nearly $1 million in medical bills.

Schloss’ sentence included both that case as well as another case in which he pleaded guilty to misdemeanor driving under the influence of alcohol.

If convicted of her charges, Henderson faces between one year and life plus 20 years in prison and a fine of up to $100,000. If convicted of his charge, Schloss faces up to five years in prison and a fine of up to $50,000, as well as the possible revocation of his prior sentence.

The next hearing for each is set for June 12. Both are currently incarcerated in the Flathead County Detention Center, where their bonds are each set at $30,000.
