A Kalispell woman has been sentenced to five years with the Montana Department of Health and Human Services after being convicted of felony attempted assault on a peace officer.

Jennifer Paquette, 43, initially was charged with felony assault with a weapon and misdemeanor assault with bodily fluid as well as the assault charge on which she was eventually convicted after an Oct. 13, 2012, incident in which she repeatedly kicked at a deputy trying to remove her from a patrol car.

The additional charges were dismissed as part of a plea agreement.

According to a court document, Flathead County deputies responded to a disturbance in a wooded area in Evergreen near the former Walmart and found two security guards holding down Paquette. One of the guards said she found Paquette and another man at a camp in the woods after hearing a disturbance.

The guard told police that she and the other guard started to leave when they heard the man yell “she’s stabbing me!” and saw the man was bleeding from his cheek.

While the guards tried to subdue Paquette, she allegedly put her hand under the entrance to the tent. The deputy reportedly found a knife under the floor of the tent near its entrance.

While transporting Paquette to jail, Paquette allegedly screamed and banged her head against the cage of the patrol car, causing her forehead to bleed.

When the deputy stopped the car to take Paquette out of the car to stop her from hurting herself, she kicked at him and hit him in the chest, also allegedly spitting in his face when he pulled her from the car.

In addition to her sentence to the health and human services department — for placement in an appropriate facility — Paquette was ordered to undergo a chemical dependency evaluation and any recommended treatment as well as completing anger management classes.

Paquette previously was charged with felony burglary in another case in which she was allegedly caught breaking into a Cottonwood Drive home. The deputy who responded to that call was the same one who transported Paquette to jail on Oct. 13, 2012.

She eventually pleaded guilty in the burglary case to amended charges of misdemeanor criminal trespass to property and misdemeanor assault, for which she was given a six-month, suspended sentence on March 11.
