Post Falls man receives felony DUI sentence

COEUR d'ALENE - A 39-year-old Post Falls man was sentenced to five years in jail this week in Kootenai County District Court for felony driving under the influence.

Michael Carmack, who will be eligible for parole after two years, was sentenced by Judge Ben Simpson and will also have his driver's license suspended for five years following his release from prison. According to a press release from the Kootenai County Prosecuting Attorney's Office, this was Carmack's fourth DUI conviction.

According to the release, Carmack was stopped Jan. 5 by an officer with the Post Falls Police Department while Carmack was driving with a blood alcohol level of .234. At the time of his arrest, he was on unsupervised felony probation for a previous DUI.

Prosecuting Attorney Barry McHugh said in the release that Carmack's sentence was "appropriate" because of the danger he presents to the community.

"Driving with a blood alcohol level content almost three times the legal limit while on felony probation for a prior DUI shows that Mr. Carmack is not amenable to the rules of probation at this time," McHugh said.

"The fixed term guarantees that Mr. Carmack will not be able to endanger our community for two years, during which time he will be evaluated by the Department of Correction to determine whether he is an appropriate candidate for parole, or continues to be a risk to the public and should spend the rest of his term in prison."
