A Somers man has been acquitted of felony criminal endangerment in the beating of a man at the Ferndale Market last year.
Following a trial that began Monday, a jury found Gaige Mower, 21, guilty of misdemeanor assault but not guilty of the felony. He originally was charged with felony aggravated assault.
Mower, along with Andrew Nelson, assaulted Antonio Valencia at the market on July 4, 2013, following a road rage incident. Nelson struck Valencia with a golf club until it broke.
Mower and Nelson were joined by Ryan Horn, who pleaded guilty to a reduced charge of misdemeanor assault for shoving Valencia down to get him out of the way of Nelson’s golf club.
He was determined to have been trying to protect Valencia, but agreed to plead guilty to the lesser charge since he could have instead grabbed Nelson to stop him.
A sentencing hearing for Mower has been set for May 13.
Nelson has pleaded guilty to felony assault with a weapon in exchange for dismissal of a second felony charge of aggravated assault. His sentencing is set for June 5.
