Plea deal resolves child porn case

SANDPOINT - A former Sandpoint man charged with possessing and distributing child pornography is pleading guilty, according to court documents.

Jerry Allen Horner is scheduled to enter pleas in 1st District Court on Monday.

Horner was charged with 26 counts of possessing child porn and six counts of distributing it after he appeared on the radar of the Idaho Internet Crimes Against Children Task force in 2012.

Horner, 50, fell under scrutiny after he allegedly offered some of the videos for downloading through an Internet file-sharing network. Police and task force agents secured a search warrant for Horner's former Sandpoint home, which led to the discovery of methamphetamine and computer devices containing videos depicting child porn and an act of bestiality.

The case was ordered into mediation earlier on Dec. 1. Three days later a pretrial settlement was offered by the state and accepted by Horner, court records show.

The multiple child porn charges were condensed into one count of distributing sexually exploitive material and two counts of possessing the same. Charges of aiding and abetting bestiality and meth possession remained unchanged.

The distribution and possession charges are punishable by up to 30 years and 10 years, respectively. Special prosecutor David Robins is recommending a fixed 14-year prison term.

The state is leaving open options for an additional period of indeterminate incarceration and consecutive sentencing, according to the pretrial offer. Horner is free to argue for a lesser sentence.

The court is not bound by any of the recommendations made at sentencing. Horner waives his appeal rights as they pertain to the conviction, but not to the sentence that's imposed.

The offer becomes void if Horner fails to appear at proceedings, violates any conditions of his pretrial release or is arrested for additional crimes.

Horner, who now lives in Spokane, Wash., is free on his own recognizance while the case is pending.
