SANDPOINT - A Washington man accused of accidentally killing another motorist in a head-on collision on U.S. Highway 2 is slated to withdraw his not-guilty plea.

A change of plea hearing in Christopher Dale Jewsbury's vehicular manslaughter case is set for Jan. 7, 2015, according to court documents.

Jewsbury is accused of driving his pickup truck left of center east of Oldtown last March and crashing into an oncoming sedan driven by Amy Lynn Brady.

Brady, a 39-year-old Pend Oreille County, Wash., resident died at the scene. Jewsbury, 51, of Spokane, was seriously injured and evacuated from the scene in a helicopter.

Jewsbury told Idaho State Police he fell asleep behind the wheel and was ultimately charged at misdemeanor level, which has drawn the ire of Brady's mother and brother.

Bonner County Deputy Prosecutor Roger Hanlon does not comment to the media, but has advised Brady's family that there was insufficient evidence to sustain a felony charge.

State police reports said marijuana and cocaine were found in Jewsbury's system following the crash, but Hanlon contends there was no evidence that he was intoxicated.

Lesley Miller, Brady's mother, asserts that Hanlon is putting on an anemic case to save taxpayers' money.

"I don't feel Amy's getting any justice," Miller said.

Jewsbury stuck with his not-guilty plea during a pretrial conference in the case earlier this month, which set the stage for a Jan. 8 trial in Bonner County Magistrate Court.

Hanlon, according to email messages he exchanged with Deputy Public Defender Susie Jensen, offered to recommend a 360-day jail sentence with 180 days suspended in exchange for a plea of guilt.

It's unclear if the offer is still valid. Hanlon said in the email that the proposal would become void if the case was not resolved at the time of the pretrial hearing.

Miller is offended that plea deals are being offered in the case

"Amy gets nothing and he gets, 'Let's make a deal,'" she said.
