Convict faces new sex assault charge

A Kalispell man previously convicted of felony theft and sexual assault charges has pleaded not guilty to a new charge of felony sexual abuse of children.
McKinley Brooks, 25, is alleged to have solicited nude pictures from a 15-year-old girl in exchange for buying her cigarettes and alcohol.
A court document alleges the girl met Brooks while walking home and gave him her phone number, with the pair then exchanging text messages and phone calls for about a month. She reportedly told law enforcement that she told him in one of the texts that she was 15 years old.
Then, in July 2013, Brooks allegedly sent her a text asking for the pictures, to which she responded by sending a nude picture as well as a picture of herself partially clothed.
Brooks’ prior convictions came as a result of stealing a number of valuable coins and rings from a Smith Lake Road home in 2010 and having sexual contact with a 14-year-old girl in 2009, when he was 21 years old.
In July 2012, Brooks was sentenced to two years and six months of incarceration with the Montana Department of Corrections followed by 22 years and six months, suspended, after pleading guilty to the theft charge and violating his original 20-year, suspended sentence in the sexual assault case.
Brooks now faces between four and 100 years or life in the Montana State Prison if convicted of the new charge, as well as revocation of his suspended sentences.
He currently is incarcerated in the Flathead County Detention Center, where his bond is set at $75,000.
The next hearing in the new case is set for Feb. 12, while revocation hearings in the two prior cases are set for Feb. 6.
