Suspect pleads not guilty to aggravated assault

A Kalispell man accused of fracturing another man’s jaw during a fight has pleaded not guilty to a felony charge of aggravated assault.

Aric Hammer, 37, entered the plea Thursday in Flathead District Court.

According to a court document, Hammer confronted the victim at a woman’s home on July 2, 2013, and began punching him.

The woman reportedly told police Hammer was on top of the victim, choking him, when she pulled him off.

Hammer allegedly told police she “was punching me in the face when I was choking” the victim.

The document states that the victim required surgery two days later to repair his jaw, which was fractured in two places.

If convicted, Hammer faces up to 20 years in the Montana State Prison and a fine of up to $50,000.

Hammer initially was incarcerated in the Flathead County Detention Center, where his bond was set at $20,000, but he later was released on his own recognizance.

His next hearing is set for May 7.
