Review pending in officer-involved shooting

SANDPOINT - The review of an officer-involved shooting which claimed the life of a Priest River woman is being handed to the Kootenai County Prosecutor's Office.
Kootenai County Prosecutor Barry McHugh said Friday that he plans to begin his review next week of investigative materials and video footage from the deadly clash outside Bonner General Health on July 2.
Jeanetta Marie Riley, 35, was shot and killed by Sandpoint Police officers after she allegedly refused commands and advanced on them with a knife.
Bonner County Prosecutor Louis Marshall said the lateral pass to his counterpart in Kootenai County is being done in accord with a critical incident memorandum of understanding in North Idaho.
"One of the key aspects of the agreement is, when feasible and practical, a prosecutor from a different county will review the case when the investigation is complete," Marshall said.
Marshall said he has been reviewing the majority of officer-involved shootings that have taken place in Kootenai County. Marshall added that he will soon be reviewing the June 22 officer-involved shooting in Post Falls.
In that incident, authorities say a heavily armed man opened fire on law officers and was wounded in the ensuing gunbattle. Marcus Anthony Rael is charged with 12 counts of assault with intent to commit a serious felony.
Rael, 24, pleaded not guilty and is awaiting trial.
Marshall said the critical incident policy allows local officials from outside agencies to conduct officer-involved shooting reviews, which saves taxpayers the expense of utilizing the state attorney general's office and its retinue of lawyers in Boise.
Moreover, it removes the potential for conflict of interest.
"I have not known any of the Kootenai County officers involved in the cases I have reviewed and Mr. McHugh likewise doesn't know or work with the Sandpoint officers involved in the critical incident which took place outside the hospital," Marshall said.
