Arfee owner sues city over dog death

COEUR d'ALENE - A Washington-based attorney for Craig Jones, owner of the dog shot and killed by Officer Dave Kelley, has filed a lawsuit seeking at least $350,000 from the city of Coeur d'Alene.

Attorney Adam Karp, of Bellingham, informed City Attorney Michael Gridley of the suit Tuesday. According to a letter written to Gridley, the lawsuit seeks damages associated with the value of Arfee, Jones' 3-year-old black Lab, and for the emotional distress and mental anguish Jones went through as a result of the incident.

On July 9, Kelley - responding with Police Recruit Officer Jason Weidebush to a report of a suspicious van parked outside the business - shot and killed Arfee. Jones was inside Java on Sherman at the time of the incident and was unaware of what was unfolding outside.

During a press conference in September, Coeur d'Alene Police Chief Lee White announced that both a "Use of Deadly Force Review Board" and an outside party concluded that Kelley's conduct was in violation of department policy.

The letter to Gridley cites several issues with how the situation was handled, including a lack of evidence that Arfee was able to get out of the van and Kelley "shooting from the hip," as evidence supporting the lawsuit.

According to Karp's letter, the shooting of Arfee was also an unreasonable seizure of Jones' property and violated his Fourth Amendment rights.

Karp has worked on several high-profile animal cases in the past, including a case last year where he won a $100,000 settlement for a Des Moines, Wash., family whose pet dog was shot by a police officer.
