MOSES LAKE - Two Moses Lake men were taken into custody on Sunday after allegedly assaulting and firing a gun at a man.

About 4:45 a.m. on Sunday morning, a 20-year-old Moses Lake resident was at a party on the 300 block of Mattson Drive, according to Moses Lake police Capt. Dave Sands. The man allegedly said something that offended others at the party.

Jose Hernandez, 23, of Moses Lake, and Jose Martin, 28, also of Moses Lake, allegedly assaulted the man by punching and kicking him.

As the man apologized for offending party guests, Hernandez reportedly pulled out a firearm and discharged a round onto the ground near the victim, yelling at him to leave.

The man began to run down Mattson Drive and looked back to see Hernandez point the firearm at him and fire an additional round in his direction.

The male victim was not struck by either round Hernandez fired.

Officers arrived at the crime scene and detained four subjects, including Hernandez and Martin.

Upon investigating the scene, officers recovered live and spent 9 mm rounds and casings, and a Ruger 9mm handgun.

Hernandez and Martin were both booked into the Grant County Jail for first-degree assault and the unlawful possession of a firearm.
