COEUR d'ALENE - A Post Falls man already serving time for lewd conduct with a minor has been sentenced to as long as 20 more years for another count.

It was Gregory Wayne Powell's second conviction for lewd conduct with a minor under 16. He was already serving a 16-year sentence at the Idaho Department of Correction for a 2006 lewd conduct conviction involving his stepson.

At his 2006 sentencing, Powell, 42, failed to disclose that he had also been molesting his two young sons. He had received a seven-year fixed sentence in that case with an additional nine years indeterminate. It was while Powell was making a plea to the parole board for release that he disclosed the additional victims.

Sex offenders imprisoned with the IDOC are required to undergo polygraph testing and sex offender treatment before being granted parole.

Prior to undergoing that testing, however, the offender is given the opportunity to voluntarily disclose the truth about all other victims in attempting to convince the parole board that the offender is ready for treatment.

In turn, when other victims are disclosed, the IDOC is required to report those offenses to the proper law enforcement agency for prosecution.

Now, by sentencing Powell to a two-year fixed sentence plus 18 years indeterminate, District Judge Fred Gibler assured that Powell, once granted parole, would be required to follow the rules of parole for a much longer time than he had previously ordered in 2006.

Gibler, in rendering the sentence, informed Powell that if he had known about the additional victims in 2006, that the first sentence would have been lengthier.

Kootenai County Prosecutor Barry McHugh praised Post Falls police and the Idaho Attorney General's Office for interviewing Powell at prison.

"Given this late disclosure and new realization that Powell presented a greater danger to the children of this community than had previously been thought, the sentence was appropriate," McHugh said.
