Stun gun ends police pursuit

POST FALLS - A wanted man who allegedly ran from police while being arrested in Post Falls late Thursday night was subdued by an officer with a stun gun, police said.

Austin Kelly, who was a passenger in a pickup that had been reported as swerving on Seltice Way, was booked into the Kootenai County jail for obstructing police, possession of drug paraphernalia and on a warrant for failure to appear for petit theft.

According to police, Kelly and the driver of the truck were suspiciously rummaging around for something in the truck when officers approached the vehicle at a gas station despite the driver already having the vehicle registration and wallet in hand.

"At this point, I was concerned about our safety as the driver's actions were not consistent with a compliant person," the officer wrote in her report.

Both occupants complied when there were instructed to exit the vehicle.

As Kelly was being detained for questioning, he allegedly pulled his hands from a sergeant's grasp and ran toward Mullan Avenue. Kelly allegedly ignored the sergeant's repeated commands to stop running.

At one point during the foot chase, Kelly allegedly reached for his waistband as if reaching for a weapon, according to the report.

"(The sergeant) chased him through alleyways and residential yards before cornering him between a fence and house," the report states. "Austin was crouched near the ground with his hands out of sight between his legs and in his waist area."

Kelly allegedly refused to show his hands after being instructed to do so and was warned that he'd be stunned if he didn't comply, the report states.

After the sergeant deployed his stun gun on Kelly, the suspect complied after being commanded to roll onto his stomach, allowing an officer to secure him in handcuffs, the report states.

Two hypodermic syringes allegedly found on Kelly were seized.

Medical personnel were called to the scene to check on Kelly after he seemed lethargic, police said. Police also transported Kelly to Kootenai Health for evaluation before booking him into jail.
