Kelsey Nicole Orr, 25, was sentenced to a two-year commitment with the Montana Department of Corrections, which is to include substance abuse treatment, plus a three-year deferred sentence in connection with a guilty plea she entered on burglary and felony drug possession charges in December 2014.

Orr’s charges stemmed from two incidents. On July 2 she was cited for speeding and a construction zone violation on U.S. Highway 2 between Libby and Troy. At that time she was also charged with the felony drug possession violation, as the arresting officer reported finding a “snort tube” that tested positive for methamphetamine.

The burglary charge was paired with a felony theft charge, resulting from a July 23 incident in which Orr was arrested in the yard of a home on First Street in Libby with several items that had been removed from the residence.

The theft charge, along with the misdemeanor charges from the traffic stop were dropped as part of the plea agreement.

Orr was remanded to the custody of the Montana Department of Corrections by Judge James Wheelis on Jan. 12.

The deferred sentence will run concurrently with the commitment, so Orr will remain in deferred conviction status for one year following her release from the Department of Corrections.

As part of the sentence, Judge Wheelis stipulated that Orr be placed with Passages for drug treatment when a spot becomes available.

Should she violate the conditions of her release or deferral she could face the maximum prison time for the burglary conviction. Montana Code Annotated lists the maximum penalty for burglary as imprisonment “in the state prison for any term not to exceed 20 years or be fined an amount not to exceed $50,000, or both.”
