Accident charges still pending

COEUR d'ALENE - It has been one year since two vehicle crashes wreaked havoc on Coeur d'Alene Lake Drive and left several people seriously injured.

No charges have been filed against Kara Powers, the woman suspected of causing the crashes, but that could change next month. Kootenai County Prosecutor Barry McHugh told The Press Thursday that a charging decision will likely be made in February.

McHugh said Powers, 33, could be charged with multiple felonies - including aggravated driving under the influence, battery, and kidnapping - for her role in the wrecks.

On Jan. 21, 2014, Patricia Desmet, 61, was driving her Subaru onto Coeur d'Alene Lake Drive when a Mercedes SUV, allegedly driven by Powers, approached on the wrong side of the road. Desmet attempted to swerve away, but was unsuccessful.

A good Samaritan, Coeur d'Alene resident Sheri Bullock, 42, pulled her Volvo SUV over and left her three children inside as she went to check on the drivers involved in the crash. At that point, Powers allegedly walked to Bullock's Volvo and got into it.

With Bullock's three children inside, Powers reportedly attempted to drive away in the Volvo. In a previous article on the incident, Bullock told The Press that her middle son was able to kick the back door open and leave the vehicle. Before jumping out of the vehicle, she said her 13-year-old son repeatedly hit Powers so she could get her daughter from the Volvo.

"It was beyond terrifying for all of us," Bullock said. "I don't even know if terrifying is the right word or if there is even a word to describe how scary the whole thing was."

Powers then reportedly drove the Volvo at high speed and eventually rear-ended a Dodge pickup on Coeur d'Alene Lake Drive near Potlatch Hill. Both vehicles rolled multiple times and seriously injured William Akin, 48, the driver of the pickup.

Kootenai County sheriff's detectives investigated the incident and sent their initial findings to McHugh's office this summer. After reviewing the report, McHugh returned the matter to the sheriff's office for further investigation.

The main component of the request, McHugh added, was for detectives to reconstruct the incident in order to accurately determine the speeds and distances of the vehicles involved in the two wrecks.

"All of those things can, and did, take quite a while," McHugh said.

Powers was on probation in 2013 - for charges of inattentive driving and possession of a pharmaceutical drug without a prescription - when the incident occurred. If charges are filed in connection with the two wrecks on Coeur d'Alene Lake Drive, McHugh said the county probation office could choose to pursue a probation violation for the 2013 charges.

McHugh was asked by The Press to comment on the length of time between the incident and his office making a determination on whether or not to charge Powers.

"We can't really make a decision until the investigation is completed," McHugh said. "We got the original investigation, we asked for additional work, and it took a while for that investigation to be completed."
