Man sentenced for campground shooting

Michael Shannon Hall, 49, received a 3-15 year sentence in Wallace for the shooting of Daniel Hubbard.

"I regret many times that morning happened. Every single day," Hall told First Judicial District Court Senior Judge John P. Luster on Monday before he was sentenced.

The judge delivered the maximum indeterminate portion of the sentence that a plea agreement in the case would allow, but the agreement locked the sentencing to a three-year fixed period.

"I'm not really happy with the three-year fixed portion. One of the reasons I accepted it is because of an open indeterminate element," said Luster, who took the case after Judge Fred M. Gibler disqualified himself April 16 according to court records.

Hall pleaded guilty in February to aggravated assault for shooting Hubbard twice at the Graham Creek Campground July 5, and Hubbard protested twice in April in front of the Shoshone County Courthouse about Hall being offered the plea deal.

Hubbard delivered a statement in court Monday.

The shooting victim explained how the incident has limited him physically and said this right hand is permanently damaged and he has bullet fragments near his spine. He presented X-rays of his injured hand to the court and lifted his shirt to show the scars the bullets left on his body.

According to an Idaho State Police report, Steven Morse, who witnessed the shooting, reported that Hall came to the campground from his adjoining property the night before the shooting occurred and drank beer until late where Hubbard was camping.

Morse said Hall was upset that Hubbard was "disrespecting him" and, although Hall returned to his property, an altercation ensued at the fence line separating Hall's property from the campground.

Morse said the two men bumped chests, and Hall fell backward, then shot Hubbard in the hand and in the body. Morse eventually wrestled the gun away from Hall and drove Hubbard to the hospital.

Morse said 10 kids were present in the campground when Hall fired the shots.

Hall later reportedly told Berger he shot Hubbard because of his "instincts kicking in."

"He un-holstered his gun at least five times. He wasn't going to leave without causing a big issue," said Morse about the incident with Hall.

Berger's police report indicates that Hall had a blood alcohol content of .152 when the officer made contact with him.
