Man convicted of third failure to register as sex offender

A man received his second and third convictions for felony failure to register as a sex offender on Tuesday.

Max Wayne Allen, 47, admitted that he, his wife and young son traveled via motor home to Flathead County in 2014 to visit. Allen said the family was thinking about moving into the area.

He gave the Flathead County Sheriff’s Office notice that he was going to be staying at an RV park but never moved in.

The family returned to the area in early 2015 and repeated the process.

Allen, who was given conditional release from jail to handle a rare genetic disorder, has a conviction from 2010 in Lincoln County for failure to register. In that case, he received a three-year suspended sentence.

Allen is a Level Three sex offender, which means he is at high risk of reoffending. Allen’s requirement to register stems from two convictions in Washington state for rape of children.

A sex offender evaluation and presentence investigation were ordered. Judge David Ortley advised Allen that he could impose a 10-year sentence in the case with none suspended.

A plea agreement calls for five-year suspended sentences in both cases.
