Prison time possible after man's fifth DUI offense

Prosecutors and defense attorneys have agreed that a man who pleaded guilty Tuesday to a fifth charge of driving under the influence should face a 10-year-sentence in the Montana State Prison.

Scott Kelly Walsh, 55, pleaded guilty to felony DUI and admitted breaking terms of his parole and probation for a 2014 DUI conviction and 2011 intimidation conviction.

The intimidation conviction came after Walsh entered a Flathead County bar and falsely claimed that there were bombs in the building.  

Walsh had been out of jail for less than a year when an officer arrested him on Aug. 24 for driving drunk on U.S. 2. Walsh admitted to the crime on the witness stand.

In addition to the 10-year sentence for both felony intimidation and one of the DUI charges, a three-year concurrent, suspended sentence could be imposed for the remaining DUI charge. By merging the DUI and felony intimidation sentences, Walsh would be parole-eligible a bit sooner. He likely would be eligible for release in 2 1/2 years, according to his defense attorney.

A presentence investigation will be conducted before Walsh is sentenced. His next court date is Jan. 7.
