Sentencing delayed for 13-year-old girl's assailant

A Kalispell man is still awaiting sentencing several months after he admitted having sex in July 2012 with a 13-year-old girl.
The sentencing delay is vexing for Flathead District Judge David Ortley and Flathead County prosecutor Alison Howard.
Jared Eugene Wink, 38, pleaded guilty to criminal endangerment charges in July after charges of sexual intercourse without consent and sexual assault were dropped as part of a plea agreement.
Wink gave an underage girl alcohol and had sex with her on one occasion; another time he took her on a fishing trip and had sex with her. The girl told investigators that Wink told her to “pinky swear” not to tell anybody.
Howard expressed her frustration that Wink has not met with a licensed mental health professional approved to perform the psycho-sexual evaluation that is required before Wink can be sentenced.
Howard said the victim’s family wants to testify at sentencing and has been waiting to fly in from another state, but a lack of completion of the presentence paperwork has made buying plane tickets difficult. Buying more tickets because the case gets delayed costs the taxpayers money, she pointed out.
“Mr. Wink pled guilty several months ago and he has not even met with Dr. Scolatti,” Howard said, referring to the doctor who was supposed to perform the evaluation.
Defense attorney Sean Hinchey said the delay was not Wink’s fault.
“This is not on Mr. Wink,” Hinchey said.
During a court hearing Thursday, Judge Ortley said he was growing weary of excuses.
“I want to get this case done,” Ortley said. “I’m not willing to go any longer. I want this done this year.”
Wink faces up to 10 years in the Montana State Prison at sentencing.
