Evaluation backlog delays sex offender sentencing

Authorities say a sex-offender evaluation backlog is the reason a man is still awaiting sentencing for failure to register as a sex offender after he pleaded no contest to the crime in April.
Damien Dinelli, 35, agreed to plead no contest to the crime and receive a two-year deferred sentence. He was charged in September 2014.
Dinelli was released from jail as the case progressed.
He was arrested again in August on felony sexual intercourse without consent charges for allegedly drugging and raping a woman on July 26. That case is set for a four-day trial in December.
On Thursday, Dinelli pleaded not guilty to a new charge of failing to register as a sex offender.
Judge David Ortley noted his frustration with the delay.
“This is the third case where we are unable to proceed with revocation because of a psycho-sexual evaluation,” Ortley said.
Prosecutor John Donovan pointed out that Dinelli’s case was actually delayed four times because of the backlog.
A jury trial for the newest failure-to-register charges was set for March 28.
