Plea agreement covers drug charges, bail jumping

Authorities have decided not to bring charges against a man for fleeing from law enforcement officers and leading them on an air chase in the Leisure Island area on Oct. 9, 2015.

Prosecutor Travis Ahner told Flathead District Court Judge David Ortley on Thursday that Scott Lee Davis, 41, would not face charges for the incident as part of a plea agreement in which he pleaded no contest to felony attempted criminal possession of dangerous drugs and guilty to felony bail jumping.

A no-contest plea does not admit explicit guilt, but it does acknowledge that there is substantial evidence not in favor of the defendant.

He also had probationary sentences for a 2006 burglary conviction and 1998 felony theft charge revoked as a result of the plea deal.

Davis told Ortley he skipped out on his trial for the drug possession charge and fled to New Mexico in 2013 because he was afraid his co-defendant, Christopher Kelly Ferarri, 40, might hurt him or his family if he proceeded to trial. Ferarri was convicted in the case.

“His friends tried stabbing me and my girlfriend at a stoplight,” Davis said. “My probation officer at the time told me I got myself into it.”

Davis said his girlfriend was pregnant at the time and he worried for her safety. He took off and laid low to avoid law enforcement for nearly two years, which resulted in the bail-jumping charge. Davis eventually returned to Flathead County.

Davis and Ferrari were accused of receiving a FedEx package from Phoenix, Arizona, that contained one-quarter ounce of methamphetamine and 46 oxycodone pills.

“I conclude there is strong evidence against you,” Ortley said of the drug case.

Davis’s attorney, Lane Bennett, said a trial may or may not have gone in Davis’ favor.

Ahner pointed out that Davis allegedly admitted to an investigator that he had come to FedEx to pick up methamphetamine.

Ortley made sure Davis understands the plea agreement recommends at least a 20-year sentence to Montana State Prison, with 10 years suspended.

Ahner has decided not to seek a persistent felony offender designation, which would allow prosecutors to pursue an enhanced sentence.

In addition to the most recent charge, Davis has been convicted of felony escape in 1994 and felony criminal endangerment in 2011.

Davis also will not be charged for the October 2015 incident where he fled a traffic stop and led deputies on a chase.

Two deputies were injured in the incident.

Drugs were allegedly found in the car, Ahner said. Two Bear Air helped find Davis.

Sentencing for the drug and bail-jumping charges has been set for May 26.
