Man denies driving drunk with child

A man denied driving drunk with a child in the vehicle in Flathead District Court on Thursday.

Brian Lee Smith, 44, pleaded not guilty to felony criminal child endangerment.

According to court documents, Smith was arrested after someone called from Emerald City Casino in Whitefish to report that Smith allegedly drove away from the casino while drunk.

When an officer stopped a vehicle matching the description given to dispatchers, the officer allegedly found Smith and a 7-year-old child in the vehicle.

Smith allegedly admitted consuming alcohol and agreed to perform field sobriety tests.

Smith allegedly showed signs of intoxication. He refused to provide a breath sample.

Two witnesses gave statements saying they believed Smith was drunk when he left the casino.

A jury trial is tentatively set for Oct. 11.
