High court to hear Bonner County case

SANDPOINT — The Idaho Supreme Court is scheduled to hear arguments in a Bonner County court case when it meets in Moscow on Sept. 1.

The case involves an action Pend Oreille View Estates brought against a group of landowners in 2013 over road improvements.

First District Judge Barbara Buchanan entered a judgment in favor of the Pend Oreille View Homeowners’ Association which granted it foreclosure of homeowners’ association liens against property owners who are members of the association.

The association filed liens against the appellants after they failed to make any payments on an assessment by the homeowners’ association for pavement of private access roads within the housing project.

The parties both filed motions for summary judgment, but the district court granted the respondent’s motion and denied the appellants’ motion. On appeal, the appellants contend that the district court erred by granting summary judgment to the association, by denying their motion for summary judgment, and for awarding attorney fees to the respondent.

Both sides seek attorney fees and costs on appeal.
