Driver files claim over crash ISP says she caused

SANDPOINT — A Coeur d’Alene woman is seeking damages for a collision which Idaho State Police said she caused.

Nazeerah Pearson-Muhammad filed a tort claim against Bonner County after she collided with a county Road & Bridge Truck on Aug. 23.

The collision occurred at the corner of State Highway 53 and Ramsey Road in Kootenai County.

Idaho State Police said Pearson-Muhammad was stopped at Ramsey and turned east onto Highway 53, into the path of the oncoming Freightliner tractor-trailer. The truck’s driver braked in an attempt to avoid the collision but was unsuccessful, an ISP vehicle collision report said.

The truck struck the rear of Pearson-Muhammad’s Saturn compact, sending it into the southern shoulder of the highway and into a barbed wire fence, the report said.

Idaho State Police said Pearson-Muhammad’s failure to yield while turning left was the sole contributing circumstance in the crash. The report also indicated the county employee was faultless in the crash and that Pearson-Muhammad would be cited for failing to yield.

However, there is no record of Pearson-Muhammad actually being cited for that offense, according to the Idaho Supreme Court Data Repository. Moreover, an insurance company investigation somehow concluded the county was 100 percent to blame for the collision, records filed with the tort claim indicate.

Pearson-Muhammad’s claim seeks $3,491 in compensation for the totaling of her Saturn.

The claim was filed in 1st District Court on Tuesday.
