Kelsie Lynn Vulgamore, 26, of Columbia Falls, received a six-month suspended sentence for misdemeanor reckless driving.
For a felony criminal child endangerment charge, Flathead District Court Judge Robert Allison dispensed a three-year deferred sentence, meaning that if Vulgamore successfully completes probation, the felony will be expunged from her record.
Vulgamore received credit for seven days time served.
Her attorney requested the court make a recommendation that she be eligible for a probationary driver’s license.
Allison ordered Vulgamore to get a chemical dependency evaluation by a state-approved evaluator.
“I want you to do that within 60 days,” Allison said. “I was concerned because I read that when you were picked up your blood alcohol level was 0.316 and that’s really high. Most people that aren’t seasoned drinkers, if you will, would be under the table at 0.316 — that’s a very high blood alcohol level so that sets off some red flags,” Allison said.
“It’s absolutely imperative that you do not drink,” the judge continued. “That’s a zero tolerance part of this sentence [that] there be no alcohol or drugs.”
On Nov. 24 a trooper responded to a report of a two-vehicle collision at the intersection of U.S. 2 and River Road, according to court documents. Vulgamore said she did not see the other vehicle as she turned and hit it.
The trooper noted that a 5-year-old child was in Vulgamore’s vehicle. Vulgamore’s breath smelled of alcohol, her eyes were bloodshot and watery and she performed poorly in several field sobriety tests.
A preliminary breath test resulted in a 0.316 blood alcohol concentration, leading to Vulgamore’s arrest.
