Charges filed for sexual assault at City Beach

A man has been charged with felony sexual intercourse without consent and misdemeanor partner or family member assault.

Charges were filed against Kenneth Herbert Kofler, 40, in Flathead District Court July 11.

Police responded to a disturbance at City Beach in Whitefish, where Kofler is alleged to have had sexual intercourse with a victim without consent, according to court documents.

Also, on July 9 Kofler is alleged to have caused bodily injury by punching, shoving and choking the victim, who used pepper spray on Kofler’s face. Police observed large bruises on the victim’s face.

The penalty for felony sexual intercourse without consent is a 2- to 100-year sentence in Montana State Prison and a maximum fine of $50,000. For misdemeanor partner or family member assault, Kofler faces imprisonment in the county jail for a minimum 24 hours to one year for a first offense and a minimum of $100 to a maximum $1,000 fine.

Bail has been set at $40,000. Arraignment will be July 21.
